Welcome to TUX WINDOW CLEANING, LTD dba Tux Holiday Lighting (“we,” “us,” or “our”). By accessing or using our website www.tuxholidaylighting.com, or by hiring us for services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before engaging our services.


1. Services Provided

Tux Holiday Lighting offers professional:

Holiday and Christmas light design and installation

Lighting maintenance and removal

Commercial and residential lighting setup

Custom décor and display enhancements

We serve Albuquerque, Rio Rancho, Santa Fe, and surrounding New Mexico areas.

All services are performed by trained technicians and are subject to the terms outlined in this agreement.


2. Estimates and Pricing

All quotes and estimates are free and non-binding unless otherwise stated.

Estimates are based on the information provided by the client at the time of the request.

Final pricing may vary based on scope changes, materials, or additional labor.

Quotes are typically valid for 30 days from the date issued.


3. Payments and Deposits

A deposit may be required to secure installation dates during peak holiday seasons.

The remaining balance is due upon completion of installation unless otherwise agreed in writing.

Accepted payment methods include credit/debit cards, cash, and electronic payments.

Late or failed payments may result in suspension of services and additional fees.


4. Scheduling and Installation

Installation schedules are provided based on weather conditions and crew availability.

Dates are subject to change due to weather, equipment availability, or unforeseen circumstances.

The client is responsible for ensuring that the installation area is accessible, safe, and free of obstructions (e.g., pets, locked gates, vehicles).

Power outlets must be functional and accessible for installation.


5. Ownership and Maintenance of Lights

Tux Holiday Lighting offers two lighting options:

Customer-Owned Lights: The client provides their own materials. We are not responsible for defective or non-compatible products.

Tux-Owned Lights (Rental Option): Lights and décor remain the property of Tux Holiday Lighting and will be removed at the end of the season.

Routine maintenance or bulb replacements due to standard wear are included during the active season. Damage caused by weather, animals, or third parties may result in additional fees.


6. Removal of Lights

Standard removal occurs after the holiday season, typically between January 2nd and February 1st.

Removal dates are scheduled in order of installation and subject to weather conditions.

Early removal requests may incur additional service fees.


7. Warranty and Liability

Tux Holiday Lighting guarantees workmanship for the duration of the active lighting season.

We are not responsible for power outages, client-supplied equipment failures, or damage caused by severe weather.

The client agrees to hold Tux Holiday Lighting harmless for any indirect, incidental, or consequential damages related to installation or use of lighting equipment.

We carry general liability insurance for all standard installations.


8. Safety and Property Access

Our crews follow strict safety protocols. By hiring us, the client grants permission to access their property for:

Installation, maintenance, and removal of lighting

The use of ladders, lifts, and extension cords as necessary

Minor fixture adjustments to secure lighting in place


9. Photo & Video Use Consent

Tux Holiday Lighting may photograph or film completed installations for marketing and promotional purposes (e.g., social media, website, or advertising).

If you wish to opt out of this, please notify us in writing before or immediately after installation.


10. Cancellations and Rescheduling

Cancellations made within 72 hours of the scheduled installation may be subject to a cancellation fee.

If installation is postponed due to weather, we will contact you to reschedule at the next available time slot.


11. Website Use

All content on www.tuxholidaylighting.com — including text, graphics, logos, and images — is the property of Tux Holiday Lighting and may not be copied, redistributed, or used for commercial purposes without permission.


12. Limitation of Liability

To the maximum extent permitted by law, Tux Holiday Lighting shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of your use of our services or website.


13. Governing Law

These Terms and Conditions are governed by and construed under the laws of the State of New Mexico, without regard to its conflict of law principles.
